Barge Colibri
Terms & Conditions

  1. The booking agreement is made between the Lead Guest and SARL Colibri Canal Cruises (operator of the Barge Colibri), hereafter called The Company / We. All other Guests within the same group are bound by the conditions of this agreement, whether named in the booking application or not.
  2. The full board cruise includes accommodation for 5 nights, breakfast, lunch and dinner each day whilst on board. The half board cruise includes accommodation for 5 nights, breakfast, lunch and the first evening’s dinner aboard. The remaining evening meals are to be taken ashore at the client’s expense. Specially selected wines are provided with meals and there is a well appointed bar, chauffeured and guided excursions, use of bicycles, and transfers between the Colibri and the nominated meeting place. Not included are airfares and transport to the nominated meeting place, personal holiday / travel insurance, use of the telephone, special excursions and activities not discussed at time of booking.
  3. The booked holiday commences with pick-up and transfer of guests to the barge and ends upon the transfer of guests to the agreed point of departure. The Company shall not be liable for any loss, damage or injury occurring before the start of the holiday, or after the end of the holiday, no matter how caused. The Company will not be liable for any loss resulting by any of the guests having incorrect documentation for entry into France; in the event that entry is refused, our standard cancellation terms will apply.
  4. A deposit of 30% is required to confirm charter booking. Receipt of a deposit is taken as acceptance of our terms and conditions. The balance is due 90 days prior to the start date of the cruise. Should the booking be made less than 90 days prior to the charter, the full balance will be due upon confirmation of the cruise. Cruise rates are quoted in Euros. Payments can be made in Euros by bank transfer. Should the balance not be received 90 days before the charter, the booking is taken as cancelled and the deposit forfeited.
  5. Cancellations over 90 days prior to departure date; the deposit shall be retained. The Company will refunded the deposit ONLY if we are able to resell the week. Within 90 days prior to departure the total fare shall be retained. After commencement of the cruise no refunds shall be allowed against any unused part of the cruise should guests elect to cancel or cut short their cruise or not take part in organised tours or meals ashore. You are strongly advised to take out comprehensive cancellation insurance.
  6. We request that you (in confidence) advise us, before booking, of any medical condition or disability that would be likely to affect your full enjoyment of your holiday with us. Where The Company reasonably can make adjustments to how we do things, we will. However, Colibri is a vessel built in 1931 to which physical adjustments cannot readily be made and unfortunately Colibri may not be fully accessible to everyone. If you have any doubts or concerns about any aspect of the accessibility and full enjoyment of your holiday with us, it is essential that you raise that with us before booking.Likewise, you must advise us, before booking, of any special dietary requirement. We cannot guarantee to provide any dietary requirement unless it is requested at the time of booking and we accept it then. Acting responsibly, we reserve the right to decline any booking if we feel unable to accommodate the specific needs of a guest. Should a requirement come to light on arrival at the barge, that has not been mentioned at the time of booking, we may have to review allowing boarding to that person.
  7. Changes in the cruising route may occur due to unexpected circumstances, such as weather, lock closures and repairs, unusually high or low water levels and other circumstances beyond our control. The Company reserves the right to alter the cruise route and excursions accordingly. Any such changes cannot be accepted as a reason for cruise cancellation. Alternative and equally agreeable routes / excursions will be chosen. Should Colibri not be available for the dates reserved, or if The Company for circumstances beyond their control cancel the cruise, all sums received will be returned in full, and guest shall have no claim against The Company. Sums will be prorated should only a portion of the trip be canceled.
  8. Except where otherwise expressly stated in these Terms and Conditions, we cannot accept liability or pay any compensation where the performance or prompt performance of the obligations under your contract is prevented or affected by or you otherwise suffer any damage or loss as a result of “force majeure”. In these Terms and Conditions, “force majeure” means an event beyond our reasonable control which we could not, even with all due care, foresee or avoid, including, but not limited to closure of navigation, strikes, lock-out, labor dispute, act of God, war, riot, civil commotion, malicious damage, compliance with a law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, natural or nuclear disaster, chemical or biological disaster, adverse weather, fire, flood, storm, sea, air, ice and river conditions and all similar events outside our or our suppliers concerned’s control.
  9. On board Colibri, we provide a safe and comfortable cruise. By booking a cruise aboard Colibri, guests recognise and accept the existence of hazards inherent in traveling aboard the barge, our vehicles and related excursions.The Company accepts no liability for injury, accident or illness to any of its guests, nor to the loss or damage to any personal effects, unless and solely in the event that it is proven that such injury or loss arises from negligence on the part of The Company, in which case the liability shall be restricted to a maximum of the price paid for the holiday. All guests are advised to carry adequate insurance for themselves and their possessions.
  10. Any event leading to a problem encountered by any of the guests must be mentioned to The Company as soon as possible after the event, and confirmed in writing. No problems or claims will be valid if raised by the Guest more than 14 days after the end of the holiday.
  11. In the event of any Guest causing damage to the vessel, or its fixtures and fittings, or to any vehicle or other property owned by The Company, The Company will have the right torecover from the Guest whatever sums are required to make good such damage. The Guests also indemnify The Company for any damage or loss sustained by third parties as a result of any action taken by the Guest(s).
  12. Every care has been taken to ensure the accuracy of all information presented by The Company in the description of the Barge Colibri and in her operation. However, all such information is for guidance only, and no liability will be accepted by The Company for any changes or inaccuracies.
  13. Your personal data shall be collected, stored and processed in accordance with relevant laws and regulations and only when strictly necessary. Your data will be used only for administering the booking of the cruise and occasional marketing emails. The Company will keep all of your personal data secure and never pass it on to a third party unless it is necessary to do so related to the booking or we are compelled to do so by law. During the cruise, we may take photographs, which could include images of guests. If we are informed at the time of taking that a guest does not wish to be included we will take all reasonable steps to ensure that there are no recognisable images of that guest retained. All intellectual property rights connected to your cruise shall be owned by The Company.
  14. Severance, if any provision or part-provision of this agreement is or becomes invalid, illegal or unenforceable, it shall be deemed deleted but that shall not affect the validity and enforceability of the rest of this agreement.
  15. These Terms and Conditions form a part of the contract between The Company and the Guest. Any dispute arising will be governed by the Law of France, and any judicial proceedings will exclusively be conducted in Toulouse. These terms and conditions are issued as of January 2023 and supersede and cancel all prior communications and agreements. For the comfort and safety of all aboard Colibri, smoking is not allowed inside the barge or its vehicles.
